ABSTRACT
Objectives:
In an era of rapid digitalization, the development of artificial intelligence, and the expansion of cyberspace (all of which offer numerous conveniences for daily life) there arise increasing threats and challenges regarding the protection of what is most significant to the individual. Personal rights (recognized by society as non-material values intrinsically linked to the human being) are, without doubt, an expression of human dignity. This dignity is not merely a legal construct; rather, it pertains to the realm of an individual’s feelings and sense of self-worth. It encompasses various facets of a person’s existence, and this sphere can be violated in both the physical and virtual worlds. Consequently, the characterization of certain personal rights as "digital" appears entirely justified. This article aims to explore the concept of "digital dignity" within the context of an individual’s personal rights and to initiate a discussion on new categories of personal rights that are closely tied to a person’s status and role within cyberspace.
Methods:
The research employed inductive, deductive, and dogmatic-legal methods.
Results:
The results obtained allow for the formulation of the thesis that digital dignity (stemming from the dignity of the individual) should be classified as a personal right.
Conclusions:
As a good of a new category, it should be protected on an equal footing with other constitutional rights and freedoms, even if it is not explicitly defined in legislation as a distinct personal right.
