ABSTRACT
Objectives:
The aim of the article is to identify instruments for the protection and penalisation of intelligence and sabotage activities in relation to state-owned companies and individuals within their structures. The author identified and discussed the role of state-owned companies in the field of national security and their role in securing the economic potential of the state. Furthermore, another objective of the work was to indicate the scope of civil and criminal liability for participation in intelligence activities and participation in acts of sabotage in state-owned companies.

Methods:
The article contains considerations on the basic acts of Polish law regulating this issue and an analysis of the available literature on the subject. The work also uses the methods of exegesis of legal texts and induction and deduction.

Results:
The considerations made have shown that the functioning of state-owned companies in various domains of state security is associated with the potential risk of intelligence and sabotage activities, including by foreign secret services.

Conclusions:
Under the current Commercial Companies Code and the Criminal Code, both intelligence and sabotage are penalised as crimes. The existing legal situation in this area also involves liability for activities detrimental to the company. The scale of sanctions for such behaviour is also related to the damage that intelligence and sabotage can cause to the activities of State Treasury companies, which in turn can affect the economic security of the state.
