ABSTRACT
Objectives:
Professional military service is voluntary. Therefore, it is the professional soldier who can decide to terminate their service. Nevertheless, the legislator has provided for circumstances in which the termination of professional military service occurs without the soldier's will. In this regard, the regulations indicate mandatory and optional grounds which will or may lead to dismissal from professional military service.

Methods:
Analysis of legal acts using the historical method

Results:
The article shows that in most cases, voluntary resignation is insufficient when it comes to professional soldiers being discharged from military service. A soldier may terminate their service relationship and, after the expiry of the term, they are discharged from military service.

Conclusions:
The legislator has rightly created two separate lists of grounds, both mandatory and optional, for exemption from military service. It is also very important that these lists are closed, limiting the possibility of the authority responsible for dismissing a given soldier from military service to indicate further grounds.
